Beta terms of use — DRAFT

Draft — not reviewed

DRAFT — pending legal review

These terms apply to the use of r365 during the closed beta. They have not yet been reviewed by a lawyer. The German version prevails.

1. Provider

James Cazzetta, Fiebertraum Studios (sole proprietorship), Oberstrasse 159, 9000 St. Gallen, Switzerland, beta@regional365.com (“we”).

2. What r365 is — and what it is not

r365 creates weekly meal plans and shopping lists for households. It takes into account the food preferences, exclusions and information you record, and calculates nutrients from stored recipe and food data.

r365 is a tool for general nutrition and household planning. It is not intended as a medical device and has not been assessed or approved as one. It is not intended to diagnose, prevent, monitor, treat or alleviate any disease, and it does not replace medical advice, dietary therapy or a diet prescribed by a doctor. If you record a condition or a medication, r365 applies general, published nutrition recommendations to choose meals; these are not therapeutic targets tailored to you. A physician or dietitian has not yet reviewed the underlying rules. Discuss dietary changes relating to illness, medication, pregnancy, breastfeeding and children with your doctor or a registered dietitian. In an emergency, call 144.

3. Beta

The beta is free of charge and aimed at a small group of testers resident in Switzerland. The service is unfinished: calculations may contain errors, features may change or be removed, and the service may be interrupted. We may end the beta or restrict access at any time; we will inform you before deleting your data. Export your data if you want to keep it.

4. Account and authority

  • You must be of age (18 or over) and capable of judgement to open an account.
  • You record data about other people (such as a partner, parents or children) only if they have consented or you are their legal representative, for example a parent with parental authority. Inform them about the privacy notice.
  • You are responsible for the accuracy of your information and the security of your access.

5. Your care when cooking

r365 knows only the stored recipe and ingredient data. It does not know the composition of the products you buy, nor traces or cross-contamination. If you have allergies or intolerances, always check the ingredient list on the packaging. Plans, nutrient values and certificates are calculations, not a guarantee that a meal is suitable or safe.

6. No warranty

The beta is provided without any representation or warranty as to accuracy, completeness, availability or fitness for a particular purpose, to the extent permitted by law.

7. Liability

To the extent permitted by law, our liability for damage arising from the use of r365 is excluded. This does not exclude liability for unlawful intent and gross negligence (Art. 100(1) Swiss Code of Obligations), for injury to life, body or health where an exclusion is not permitted, or any other mandatory statutory liability, in particular under the Product Liability Act. Liability for auxiliary persons is excluded to the same extent (Art. 101 Code of Obligations).

8. Termination

You may delete your account in the settings at any time. We may suspend or delete an account that is used abusively or contrary to these terms.

9. Changes

We may change these terms. We will announce material changes in the app or by email. If the consent text for health data changes, we will ask for your consent again.

10. Governing law and place of jurisdiction

Swiss law applies, excluding its conflict-of-laws rules. The place of jurisdiction is St. Gallen. Mandatory places of jurisdiction remain reserved, in particular that at a consumer’s domicile (Art. 32 and 35 Swiss Civil Procedure Code).
